Airport Taxi provides services based on the terms and conditions, the service descriptions and the price lists. Differing terms and conditions do not apply, even if Airport Taxi does not expressly object to them. Deviations from these conditions require the express written acceptance of Airport Taxi. A contract is only concluded if it is confirmed by Airport Taxi.
The scope of services is determined exclusively according to the written order confirmation from Vienna Taxi Airport or, secondarily, the written offer from Vienna Taxi Airport. Information contained in brochures, service catalogues, price lists and similar information is only binding to the extent that it is expressly referred to. Transport takes place by the regulations of the StVO and the PbefG. Passengers must adhere to the instructions of the Vienna Taxi Airport or the chauffeur. Suppose guests act contrary to the education or pose a threat according to the StVO or road traffic safety by interfering with the chauffeur. In that case, Vienna Taxi Airport is entitled to exclude them from transport. In this case, Vienna Taxi Airport charges the total fare, including the fixed or kilometre price and all ancillary and unique services.
Any change to the agreed pickup time, regardless of the reason, must be reported to the WIEN AIRPORT DRIVER immediately. The buyer will bear any damage resulting from failure to report immediately. The Vienna Taxi Airport chauffeur will be available to you at the agreed pickup time at the appropriate meeting point in the airport terminal or at a meeting point previously agreed in writing with a nameplate or company logo (earlier or later availability must be specified when booking). And waits up to 60 minutes at no extra charge. The telephone number where the passenger can reach their chauffeur is listed on the website. If no contact with the passenger or customer is made after 60 minutes of waiting, the chauffeur will return to Vienna without the passenger. The service of the Vienna Taxi Airport is then deemed to have been provided, and the total price is due for payment. Additional waiting times at the customer's request will be calculated according to the currently valid price list.
The prices include the statutory sales tax at the respective statutory rate. The prices valid on the day of the booking confirmation apply. Flat rates not listed in the price list can only be agreed in writing and only apply to the agreed travel date and rental period. Times and distances beyond this will be calculated according to the valid price list. Additional costs due to delays are borne by the customer unless the delays are due to the fault of the airport taxi or the chauffeur. The fare includes passenger transport with regular luggage. Taking along bulky goods requires a separate agreement.
Airport Taxi reserves the right to charge a deposit of up to 50% of the total price before the start of the journey or to request a blank debit receipt issued to Airport Taxi from a valid credit card before accepting an order. The remaining payments are due within the deadlines stated on the invoice. The timeliness of compensation depends on the receipt of the amount for the unconditional disposal of the airport taxi. When paying by check, the claim is only considered paid once fully credited. Payments are always used to settle the oldest debt. Suppose the customer is in default of payment. In that case, Airport Taxi will charge interest of 5 percentage points above the base interest rate, subject to the assertion of further damages caused by the delay. A reminder fee of 10€ will be charged for the second and each subsequent reminder. The customer reserves the right to prove lesser damage.
Cancellations will only be effective if they are made in writing or confirmed in writing by Airport Taxi if made verbally. The timeliness of written cancellations depends on access to the airport taxi. Cancellations up to and including 24 hours before the contractually agreed start of the trip are free of charge. In the event of cancellations, Airport Taxi charges a portion of the essential trip price as compensation. This proportion is:
Airport taxi charges expenses regardless of the timeliness of cancellations if they have already been incurred. The customer is expressly permitted to provide proof that the airport taxi did not suffer any damage or that the damage was lower. Airport Taxi reserves the right to withdraw from the contract in whole or in part if the customer stops paying, becomes insolvent or, due to external circumstances, it can be assumed that the services are being misused or the customer breaches an obligation incumbent on him according to these contractual provisions.
The customer immediately informs Flughafen Taxi of any change to his name, (billing) address, legal form and bank details. The customer must also provide the necessary information about passengers, time and place of service provision. If the customer fails to provide immediate notification, he will be liable for damages that would have been avoided if information had been made on time. The customer undertakes, also on behalf of the passengers, not to misuse the airport taxi service, in particular:
If a customer violates the obligations above, Airport Taxi is entitled to take all necessary measures to eliminate the abuse. In a culpable violation, the customer is liable to the airport taxi for damages.
Airport Taxi is liable to the customer for damages - regardless of the legal basis - only in the event of intent gross negligence or culpable violation of essential contractual obligations by Airport Taxi, its legal representatives or vicarious agents. Liability for injury to life, body or health is governed by statutory regulations. In the event of material damage, the airport taxi's liability is limited to €1,000.00 per passenger.
There is a liability violation for the vehicles by the applicable general insurance conditions. The customer must take care of any additional insurance themselves. Airport Taxi is not liable for missed appointments and their economic consequences, provided that these are not the fault of Airport Taxi. This includes, for example, delays/delays caused by:
Airport Taxi assumes no liability to the customer or passenger for damage resulting from incorrect data transmission by the customer.
Austrian law applies exclusively to all legal relationships between the airport taxi and its customer. The place of jurisdiction and place of performance is Vienna.
Should one or more of the above conditions be ineffective, the remaining conditions remain unaffected by the ineffectiveness. The statutory provisions take the place of invalid clauses.
